The Creative Agency – Creator Terms of Service

1. General Terms (All Tiers)

1. Confidentiality: All non-public business information, contract terms, and financial details must be kept confidential. This obligation survives termination.

2. Professional Conduct: Creators agree to represent themselves and the Agency professionally in all brand communications.

3. No Guarantee: Agency cannot guarantee deals, brand responses, or income. Results depend on market trends, brand budgets, and Creator engagement.

4. Governing Law: Commonwealth of Massachusetts.

5. Termination: All tiers are month-to-month. Either party may terminate with 30 days’ written notice. Deals in progress remain subject to commission obligations. No proration of fees; full monthly fees are owed.

 

2. Tier-Specific Terms

A. Non-Exclusive (Commission-Only Option)

• Activation Fee: $350 one-time (credited toward first $3,000 in deals)

• Commission Structure:

  • 35% on deals < $4,000

  • 25% on deals $4,000–$10,000

  • 20% on deals > $10,000

• Term: Month-to-month

• Non-Exclusivity: Creator may work with other agencies or brands independently.

• Non-Circumvention: Creator may not bypass the Agency for any Agency-sourced brand for 3 months.

B. Tier 1.5 (Inbound Only)

• Monthly Fee: $300/month

• Services Included:

  • Inbox management + negotiation (inbound only)

  • Templates: Pitching Template

  • 20–25 brands managed, 3–5 deals/month

  • Overage: $50 per additional negotiation or upgrade to Tier 1

• Term: Month-to-month

• Termination: 30 days' written notice required for non-renewal

 

C. Tier 2 (DIY Pitch Kit)

• Monthly Fee: $100/month

• One-Time Setup Fee: $199

• Services Included:

  • 100 curated brands per month

  • Negotiation Template

  • Monthly Creator Game Plan

• Term: Month-to-month

• Termination: 30 days' written notice required for non-renewal
